The right to health is recognised most clearly in those Australian laws that provide protection against risk to the health of citizens. These include legislation concerning unhealthy premises, food hygiene, the use of tobacco, alcohol and other drugs, both legal and illegal, liability for defective products and accidental injury. Laws relating to the abatement of and liability for nuisance also recognise this right. How these laws recognise the right of health is addressed here. Other laws also recognise the right to health in this broad sense.

These are laws relating to environmental protection, especially industrial pollution, laws providing for the prevention of occupational injury and disease and laws providing for the prevention, control and treatment of infectious diseases.
